AvGeek Hangar

Hangar Exchange Seller Terms

These terms apply when an individual submits pre-owned flight simulation hardware or related equipment to AvGeekHangar for possible purchase through Hangar Exchange. Hangar Exchange is not a peer-to-peer marketplace: where AvGeekHangar agrees to buy an item, AvGeekHangar purchases it from the seller and may later resell it in its own name.

The Hangar Exchange process at a glance

  1. You submit details and photographs of your item.
  2. We review the submission and may decline it, ask for more information or make a provisional offer.
  3. If we wish to proceed, the item is sent or delivered to AvGeekHangar for inspection and testing under the arrangements we agree with you.
  4. We inspect and reasonably test the item.
  5. We confirm the provisional offer, make a revised offer, or decline to purchase.
  6. You choose whether to accept any final/revised offer.
  7. If accepted, we pay you and ownership transfers to AvGeekHangar in accordance with these terms.
  8. AvGeekHangar may then prepare and resell the item as a Hangar Exchange product.
  9. About Hangar Exchange

Hangar Exchange is operated by AvGeekHangar Limited, Company No. 17199236, registered in England and Wales.

These Seller Terms govern the proposed sale of used goods by you to AvGeekHangar. They do not govern a customer’s later purchase of the item from AvGeekHangar.

Submitting an item does not guarantee that AvGeekHangar will buy it.

  1. Who can sell to us

You must be at least 18 years old and legally capable of selling the item.

These terms are intended for private individuals selling their own pre-owned equipment.

If you are acting in the course of a business, trade or profession, or regularly acquiring goods for resale, you must tell us before proceeding because different commercial terms may be required.

We currently accept submissions only where we are able and willing to operate the transaction within the United Kingdom.

  1. Items we may consider

Hangar Exchange is primarily intended for flight simulation hardware, peripherals, cockpit equipment and closely related products that AvGeekHangar considers suitable for resale.

We decide which categories, brands and individual items we wish to consider. We may decline an item without being required to make an offer.

There is no published minimum item value at launch. We assess submissions individually and may decline an item where it is uneconomic to process or otherwise unsuitable for Hangar Exchange.

We may also decline items that are unsafe, excessively damaged, obsolete for our purposes, impractical to ship, difficult to test, counterfeit, subject to account locks or licensing restrictions, or otherwise unsuitable for Hangar Exchange.

  1. Your ownership and right to sell

By submitting an item, you confirm that:

  • you are the legal owner of the item and have the unrestricted right to sell it;
    • the item is not stolen or obtained unlawfully;
    • it is not subject to hire purchase, finance, rental, a security interest or another person’s ownership claim;
    • it is genuine to the best of your knowledge and is not counterfeit;
    • no third party has a right that would prevent AvGeekHangar acquiring and reselling it; and
    • the information you give us is honest and accurate to the best of your knowledge.

We do not routinely require ID or proof of purchase from every seller. We may request reasonable evidence of identity, ownership, purchase, serial number or provenance where the value, nature or circumstances of a submission justify it. We may decline a transaction if satisfactory evidence is not provided.

We may decline or pause a transaction if we reasonably have concerns about ownership, authenticity or provenance.

  1. Describing your item

You must describe the item honestly and provide reasonably accurate photographs and information.

Please tell us about anything material that you know about, including:

  • faults or intermittent faults;
    • damaged or unreliable buttons, switches, axes, displays, connectors or controls;
    • previous repairs;
    • modifications;
    • missing parts or accessories;
    • cosmetic damage;
    • liquid damage;
    • power or connection issues;
    • software, firmware, activation or account issues;
    • non-original components; and
    • anything else that could materially affect operation, safety, desirability or resale value.

We understand that a private seller may not know about a hidden or intermittent fault. These terms require honest disclosure of what you know; they do not assume that you can identify every possible defect.

  1. Photographs and information supplied

Photographs should reasonably represent the actual item being submitted.

By supplying photographs and product information, you give AvGeekHangar permission to use them internally to assess the item and administer the proposed transaction.

AvGeekHangar will normally take its own photographs if the item is later offered for resale.

  1. Provisional valuations and offers

Any valuation or offer made before AvGeekHangar has physically inspected and tested the item is provisional unless we expressly state in writing that it is final.

A provisional offer is based on the description, photographs, specification, accessories and other information supplied by you.

It is not a binding obligation on AvGeekHangar to buy the item at that price.

A provisional offer is normally valid for 7 calendar days from the date it is issued. You must confirm within that period that you wish to proceed with inspection. If the offer expires, we may reassess the item and issue a new provisional offer.

  1. Sending or delivering an item to AvGeekHangar

If we wish to inspect an item, we will agree the next step with you before it is sent.

The standard process is for you to send the item to AvGeekHangar at your own cost using a suitable tracked service with appropriate compensation/insurance for the item’s value. AvGeekHangar may, at its discretion, arrange or fund transport for a particular item. In-person delivery to Bull Farm may be offered by prior arrangement only; we do not operate a public walk-in drop-off service.

The party responsible for initial transport arrangements and costs will be confirmed before shipment.

Do not send an item to AvGeekHangar without our agreement and instructions.

  1. Packaging and transit

Where you arrange transport to AvGeekHangar, you are responsible for packing the item appropriately for its size, weight, fragility and value.

We strongly recommend a tracked service with appropriate compensation or insurance for valuable equipment.

Responsibility for loss or damage while an item is being transported to AvGeekHangar will depend on who arranged the transport and the agreed arrangements. We will make the applicable arrangement clear before shipment where reasonably possible.

Once we confirm physical receipt, we will take reasonable care of the item while it is in our possession.

  1. Permission to inspect and test

By sending or delivering an item for assessment, you authorise AvGeekHangar to carry out reasonable inspection and functional testing for the purpose of deciding whether to buy it and assessing its condition.

We aim to inspect and test an item within 3 working days of confirmed receipt. This is a target rather than an absolute guarantee; unusual products or faults may require additional time, in which case we will keep you informed.

Testing may include, where appropriate:

  • visual inspection;
    • checking serial/model information;
    • checking supplied accessories;
    • connection to suitable power, computer or simulator equipment;
    • checking buttons, switches, axes, displays and controls;
    • reasonable calibration or configuration;
    • checking basic firmware or device recognition;
    • reasonable functional operation; and
    • identifying obvious faults or inconsistencies with the submission.

We will not intentionally carry out destructive testing.

Testing is a reasonable resale assessment, not a manufacturer’s inspection or certification and cannot guarantee discovery of every intermittent, hidden or future fault.

  1. Software, firmware and configuration

Testing may require reasonable configuration, calibration, driver installation, firmware checking or resetting.

Where a reset is reasonably necessary to test or prepare a device, we may carry it out provided doing so is appropriate for the product.

You should tell us before shipment if there is a particular configuration, firmware state or other feature that must not be altered.

  1. Personal data and stored information on devices

Before sending equipment capable of storing information, you are responsible for removing your personal files, saved credentials, accounts and removable storage media and, where appropriate, performing a suitable factory reset.

You should sign out of linked accounts and remove activation locks that would prevent lawful testing or resale.

AvGeekHangar may reset or erase a device as reasonably necessary for testing or resale preparation, but you should not rely on us as a data-erasure service.

Our handling of personal information supplied as part of the transaction is covered separately by the AvGeekHangar Privacy Notice.

  1. Software licences, subscriptions and digital accounts

Do not include software licences, subscriptions, digital accounts or other digital entitlements as part of the proposed sale unless they are legally transferable and you have specifically told us about them.

An installed program, licence or account will not automatically be included in our valuation.

Where a licence or account is non-transferable, it must not be represented as part of the item being sold.

  1. What happens after inspection

After inspection and testing, AvGeekHangar may:

  1. confirm the provisional offer;
  2. make a revised offer where the item’s actual condition, specification, functionality, authenticity, accessories or other material characteristics differ from what was reasonably expected; or
  3. decline to purchase the item.

Where we revise an offer because of something identified during inspection, we will explain the material reason for the revision.

  1. Revised offers

You are not obliged to accept a revised offer.

If we make one, you may accept it or decline it.

If you decline, ownership remains with you and we will arrange for the item to be returned in accordance with the return arrangements and costs agreed or disclosed before the item was sent.

We will not retain an item merely because you refuse a reduced offer.

  1. Final acceptance and contract of sale

No sale to AvGeekHangar is completed merely because you submitted an item, received a provisional valuation or sent the item for testing.

The sale is agreed when you accept AvGeekHangar’s final offer through the acceptance method we provide.

Once accepted, you authorise AvGeekHangar to pay the agreed purchase price using the agreed payment method.

  1. Payment

Payment is made by bank transfer to a UK bank account nominated by the seller. We aim to make payment within 2 working days after you accept our final offer, subject to any reasonable verification required to complete the transaction. Bank details should only be supplied through the payment process we provide.

We will make payment within the timeframe communicated to you after final acceptance, subject to any reasonable verification required to complete the transaction.

You are responsible for providing accurate payment information.

AvGeekHangar will not charge a private seller a hidden commission deducted from an accepted final purchase price. If any fee or deduction ever applies to a particular transaction, it must be made clear before you accept the final offer.

  1. When ownership transfers

Unless we expressly agree otherwise in writing, ownership of the item transfers to AvGeekHangar when:

  • you have accepted our final offer; and
    • AvGeekHangar has made the agreed payment to you.

Until then, the item remains your property even while it is physically with us for inspection.

After ownership transfers, AvGeekHangar may clean, test further, repair where appropriate, prepare, photograph, advertise, bundle, price and resell the item in its own name.

  1. AvGeekHangar’s resale price

The amount AvGeekHangar later advertises or sells the item for is independent of the purchase price agreed with you.

Our resale price may take account of testing, preparation, cleaning, packaging, payment fees, delivery, consumer returns, warranty/statutory obligations, business overheads, market demand and commercial margin.

Once you have accepted the final offer and ownership has transferred, you have no entitlement to a share of any later resale price or profit unless we expressly agree otherwise in writing.

  1. If we decline the item

If AvGeekHangar decides not to purchase the item after inspection, ownership remains with you.

We will contact you and arrange return using the process previously agreed or otherwise reasonably agreed with you.

We will not deliberately dispose of your property merely because we have declined to buy it.

  1. Return costs where no sale completes

If the item materially matches the information you supplied but AvGeekHangar decides not to purchase it after inspection, AvGeekHangar will pay the reasonable cost of returning it to you.

If inspection identifies a material difference from the information you supplied and we make a revised offer which you decline, you will be responsible for the reasonable cost of returning the item. We will not apply this rule for trivial differences or use return charges to pressure you into accepting a revised offer.

Any such cost rule should be communicated before shipment wherever reasonably possible. We will not impose an undisclosed or disproportionate charge simply to compel a seller to accept a revised offer.

  1. Unresponsive sellers and uncollected items

If an item remains your property and we need instructions to return it, we will make reasonable attempts to contact you using the details supplied.

If we need your instructions and you do not respond within 14 calendar days of our request, we may send a reminder and make further reasonable attempts to contact you. Silence will not be treated as acceptance of a revised offer.

We will not treat silence as acceptance of a revised offer.

Where property remains uncollected for a prolonged period, AvGeekHangar will act reasonably and in accordance with applicable law before taking any further step. We reserve the right to recover reasonable storage or return costs where legally permitted and where appropriate notice has been given.

  1. Loss or damage while in our possession

Once AvGeekHangar has confirmed physical receipt of an item, we will take reasonable care of it while it remains in our possession.

If the item is lost or damaged because AvGeekHangar failed to take reasonable care, we will work with you to provide an appropriate remedy based on the circumstances and the item’s reasonable value.

We are not responsible for pre-existing defects, ordinary consequences of reasonable authorised testing, or loss caused by circumstances for which the law does not make us responsible.

  1. Unsafe, counterfeit or suspicious goods

We may immediately stop testing or decline a transaction if we reasonably believe an item may be unsafe, counterfeit, stolen or otherwise unlawful to possess or resell.

Where we reasonably suspect criminal property or another serious legal issue, we may need to retain information or cooperate with law-enforcement or other authorities as required by law.

We will not knowingly purchase or resell counterfeit or stolen goods.

  1. Withdrawal before the sale completes

You may tell us that you no longer wish to proceed at any time before you accept our final offer.

If the item is already in our possession, it will be returned under the applicable return arrangements. You may be responsible for a previously disclosed reasonable return cost where that was part of the agreed assessment process.

Once you accept the final offer and the sale is completed, you cannot simply reclaim the item because AvGeekHangar subsequently advertises it for a different price.

  1. Our right to withdraw before completion

AvGeekHangar may withdraw a provisional or final offer before you accept it where there is a legitimate reason, including a material error, new information about the item, authenticity or ownership concerns, or an offer that has expired.

We will act reasonably and will arrange return of an item that remains your property.

  1. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or other liability that cannot legally be excluded.

Neither party is responsible to the other for losses that were not reasonably foreseeable consequences of a breach, except where the law provides otherwise.

  1. Changes to these terms

We may update these Seller Terms for future submissions.

The version applying to your transaction will normally be the version presented to you when you submit or otherwise agree to the Hangar Exchange assessment process.

We will not retrospectively change agreed terms in order to reduce rights relating to an existing transaction.

  1. Governing law and disputes

These terms are governed by the law of England and Wales.

If a disagreement arises, please contact help@avgeekhangar.com first so that we can try to resolve it.

Nothing in these terms removes any legal right or remedy that cannot lawfully be excluded.
